# Manage India Property Without Power of Attorney, 2026

**Short answer:** You can inspect, monitor, pay property tax, run a title and encumbrance check, and take a written risk report on your India property without giving anyone Power of Attorney. What needs a POA is acting in your name: signing a rental agreement, registering it, appearing before a registrar, collecting rent into an account you do not control, or dealing with a sale. Do the no-POA work first, then give a narrow, registered, revocable POA only for the specific act that needs one.

# Manage Your India Property Without Power of Attorney

Most owners abroad are told the first step is a Power of Attorney. It is not. A POA is the last step, for the one act that cannot happen without it, and most of what you need done does not need one at all.

This page splits the work into three: what needs no POA, what needs one, and how to write the one you sign in the end so it cannot be turned against you.

## What needs no power of attorney

You can have all of this done in your absence with nothing more than an instruction and a fee.

**A site visit and photographic record.** Somebody walks the flat or the plot, photographs it dated, checks the doors, the meters, the water, the boundary and the neighbours. No authority over the asset is involved in looking at it.

**An encumbrance certificate.** Public record. Anyone can apply for the encumbrance certificate on a property with the survey and registration details.

**Khata, mutation and property-tax status.** Municipal records are searchable and dues are payable by anyone. Paying your BBMP, GHMC, MCGM, PMC or AMC bill on your behalf needs your property ID, not your authority.

**A title and document review.** A lawyer reading your sale deed, mother deed, khata and approvals needs the documents, not a POA.

**Encroachment and boundary checks on vacant land.** A GPS boundary survey against the plot dimensions in your deed is a survey, not an act in your name.

**Society and maintenance dues.** A society will accept payment and issue a receipt from anyone paying against your flat number.

## When a power of attorney is unavoidable

The test is whether somebody has to stand in your place and bind you. If yes, you need a POA.

- Signing and registering a leave-and-licence or rental agreement in your name, and appearing before the sub-registrar for it.

- Registering documents where the registrar requires the owner or an authorised attorney to appear in person.

- Collecting rent into an account you do not operate, or paying vendors from your money.

- Sellinging, gifting or mortgaging. A sale executed by an attorney needs a Special Power of Attorney drafted for that sale and registered, and the buyer's lawyer will read it word by word.

- Court and revenue proceedings where somebody must appear for you.

Two points owners get wrong here. And a POA executed abroad has its own execution route, through the Indian consulate or through apostille and stamping in India, which is a separate question from whether you need one at all.

## How to keep rent flowing without handing over custody

The arrangement that avoids the widest POA is simple and most owners are never offered it.

- Rent goes to your own NRO account. The tenant transfers to you. The manager reconciles and chases, and never holds the money.

- The agreement carries your signature, executed by post or in person on a visit, rather than by an attorney.

- Vendor work is billed to you at actuals with receipts, and anything above an agreed floor waits for your written approval before money moves.

- The manager holds an authorisation letter for specific tasks, not a POA. A letter authorising somebody to represent you to the society, the municipal office or a utility is narrower than a POA and revocable in a sentence.

That covers most of a tenancy. Where it stops is registration of the agreement, which in several states needs the owner or an attorney at the registrar's office.

## When you do sign one, sign the narrow version

Six rules, and they are the difference between a tool and a liability.

- Special, never general. Name the property, the acts, and nothing else.

- Name the person, not a company or a role. A POA to whoever holds a job title is a POA to a stranger.

- Put an expiry date in it. A POA with no end date outlives the reason it was written.

- Exclude sale, gift and mortgage in writing, unless selling is the exact act you are authorising.

- Register it. An unregistered POA for property acts is worth less than the paper, and registration creates the record you need to revoke it against.

## FAQ

**Can I rent out my flat in India without giving Power of Attorney?**
Largely, yes. You can sign the rental agreement yourself, have rent paid into your own NRO account, and have a manager handle screening, repairs and chasing on an authorisation letter. Where a POA is often needed is registering the agreement before the sub-registrar, since several states require the owner or an authorised attorney to appear.

**Do I need a POA for a property inspection?**
No. Inspection, photography, boundary survey, encumbrance search, khata and tax-dues checks all work on public records and physical access, not on authority to act in your name.

**Can somebody pay my property tax without a POA?**
Yes. Municipal portals accept payment against the property identification number from any payer, and the receipt is issued in the property's name.

**Is a POA needed to sell property in India as an NRI?**
Only if you will not be present to execute and register the sale deed. If you cannot travel, the route is a Special Power of Attorney for that sale, executed from where you live through the consulate or the apostille route and registered in India. Buyers and their banks scrutinise it, so a loose one delays the sale rather than speeding it.

**What is the safest first step for an owner who trusts nobody in India?**
Buy proof before you give authority. A paid inspection with a written report costs you nothing in control: no keys, no POA, no money custody. Decide who to trust after you have read what they found.

## The order that keeps you in control

Owners who get into trouble sign the POA first and find out what the property needs afterwards. Reverse it.

- Buy the record. An inspection, an encumbrance certificate, khata and mutation status, tax dues and a written report cost a fee and nothing else. No keys, no authority, no custody.

- Decide what you want done. A vacant plot that needs watching is a different job from a flat you want let this quarter.

- Give the narrowest instrument that does that job. An authorisation letter for a society or a utility. A registered Special POA for a registration appearance or a sale. Nothing wider.

- Diarise the end. Note the expiry date and the revocation route the day you sign, not the day you need it.

The failure the courts see most often is step three skipped: a general POA handed to a person the owner had no reason to doubt at the time, then used years later for an act the owner never contemplated.
